AGREEMENT TO TERMS
These terms of use between you and TBLE constitute a legally binding agreement made between you, whether personally or on behalf of an entity (“you”) and TBLE (“Company”, “we”, “us”, or “our”, concerning your access to and use of the www.tblescapes.com website as well as any other media form, social media channel, mobile website or mobile application related, linked, or otherwise connected thereto (collectively, the “Site”). By accessing or using any of the Services, you acknowledge that you have read, understood, and agreed to be bound by these Terms. IF YOU DO NOT AGREE WITH ALL OF THESE TERMS OF USE, THE YOU ARE EXPRESSLY PROHIBITED FROM USING THE SITE AND YOU MUST DISCONTINUE USE IMMEDIATELY.
Additional terms and conditions or documents that may be posted on the Site from time to time are hereby expressly incorporated herein by reference. We reserve the right to make changes or modifications to these Terms of Use at any time and for any reason. We will alert you about any changes by updating the “Last updated” date of these Terms of Use, and you waive any right to receive specific notices of each such change. It is your responsibility to review these “Terms of Use” to stay informed of updates. You will be subject to and in so doing, accept the changes in any revised Terms of Use by your continued use of the Site after the date such revised Terms of Used are posted. The information provided on the Site is not intended for distribution to or use by any person or entity in any jurisdiction or country where such distribution or use would be contrary to law or regulation or which would subject us to any registration requirement within such jurisdiction or country. Accordingly, those persons who choose to access the Site from other locations do so on their own initiative and are solely responsible for compliance with local laws, if and to the extent local laws are applicable. The Site is intended for users who are at least 18 years old. Persons under the age of 18 are not permitted to use or register for the Site. TBLE provides table settings and other related events products for rent for an agreed period (the “Products”). Products may be rented for use by individuals under 18 years of age, but we rent only to people 18 years of age or older, who may rent the Products with a payment card or other approved payment method.
GENERAL CONDITIONS
We reserve the right to refuse service to anyone for any reason at any time.
You understand that your content (not including credit card information), may be transferred unencrypted and involve (a) transmissions over various networks; and (b) changes to conform and adapt to technical requirements of connecting networks or devices. Credit card information is always encrypted during transfer over networks.
You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Service, use of the Service, or access to the Service or any contact on the website through which the service is provided, without express written permission by us.
The headings used in this agreement are included for convenience only and will not limit or otherwise affect these Terms.
MODIFICATIONS TO THE SERVICE AND PRICES
Prices for our products are subject to change without notice.
We reserve the right at any time to modify or discontinue the Service (or any part or content thereof) without notice at any time.
We shall not be liable to you or to any third-party for any modification, price change, suspension or discontinuance of the Service.
PRODUCTS OR SERVICES
We make every effort to display as accurately as possible the colors, features, specifications, and details of the products available on the Site. However, we do not guarantee that the colors, features, specifications, and details of the products will be accurate, complete, reliable, current, or free of other errors, and your electronic display may not accurately reflect the actual colors and details of the products. All products are subject to availability, and we cannot guarantee that items will be in stock. We reserve the right to discontinue any products at any time for any reasons. Prices for all products are subject to change.

Certain content, products and services available via our Service may include materials from third-parties.
Third-party links on this site may direct you to third-party websites that are not affiliated with us. We are not responsible for examining or evaluating the content or accuracy and we do not warrant and will not have any liability or responsibility for any third-party materials or websites, or for any other materials, products, or services of third-parties.
We are not liable for any harm or damages related to the purchase or use of goods, services, resources, content, or any other transactions made in connection with any third-party websites. Please review carefully the third-party's policies and practices and make sure you understand them before you engage in any transaction. Complaints, claims, concerns, or questions regarding third-party products should be directed to the third-party.
DELIVERY
Your Products may be ordered and delivered to you, within a distance specified on Site, using the standard delivery period. The delivery cost is subject to change at will.
COLLECTIONS. If you do not pay the amounts you owe to TBLE when due, then TBLE will need to institute collection procedures. You agree to pay TBLE costs of collection, including without limitation reasonable attorneys' fees.
B. Specific Rental Conditions
RENTAL FEE. The rental fee (“Rental Fee”) for any Product will be the total of the rental fee, insurance charges and delivery charges listed on the Site or App for your rental of the Product. When you place your rental order for a Product, you hereby authorize TBLE to charge your payment card for the Rental Fee. TBLE will charge your payment card the amount of the Rental Fee immediately upon your rental order. A reservation of a Product on the Site is an order for the rental of that Product, regardless of how far in advance that Product is reserved.
CANCELLATION POLICY. You may cancel your rental order subject to the following cancellation fees and policies:
If you cancel thirty (30) or more days in advance of the delivery date, there is no cancellation fee and you will receive a full refund issued to the payment card you used for the order.
You may not cancel thirty (30 ) or fewer days in advance of the delivery date.
RETURN PACKAGING. With delivery of the Product, TBLE will provide you with the necessary equipment to return the Products in the best condition possible, as well as instructions for your use in returning the Products to TBLE (“Return Packaging”). The TBLE packaging materials are not yours to keep. If the TBLE packaging materials are not returned you will be charged a $100 fee.
RECEIPT OF THE PRODUCTS. Upon delivery, you bear responsibility for the Product(s). TBLE does not bear liability for Products left unattended.
USE OF THE PRODUCTS. By renting Products from TBLE you agree that it is for a legitimate purpose and not to engage in unfair and/or illegal business activities or competition. You agree to treat the Products with great care. You are responsible for loss, destruction or damage to the Products due to theft, mysterious disappearance, fire, major stains or any other cause, other than normal wear and tear. Normal wear and tear encompasses minor stains, scratches, or other minor damage that is easily and inexpensively repaired. If you return a Product that is damaged beyond normal wear and tear, then you agree that we shall charge you, and you shall pay, for the price for repairing or replacing the Product, as determined in our discretion, up to the Retail Value for the Product.
RETURN OF THE PRODUCTS; EXTENSIONS. You agree to return the Products for a TBLE pick up in the Return Packaging on the return date for the Products that are identified in the online invoice for your order. You may extend your order for a Product on the Site or by email to TBLE; provided that any extensions are subject to other orders for that Product and to pre-payment of the additional Rental Fee applicable to that Product for the period of time of the extension. If you do not return the Products at the designated time, a late fee of $150.00 will be charged to the payment card you used to pay the Rental Fee or to any other payment card included in your account information that you have provided to TBLE. If you have not returned a Product within ten (10) days after the return date for the Product, your late return will be considered a non-return and TBLE will charge your payment card an amount equal to 200% of the Retail Value plus the Rental Fee, in the aggregate.
CORRECT PRODUCTS. We will deliver the Products you ordered, including the specified quantity and design, on the delivery date for which you ordered them, except in the rare event that the Product is damaged beyond repair or is otherwise unavailable. In such event, we will use reasonable efforts to notify you that the Product is unavailable. If we are able to reach you, you will be entitled to choose any available replacement Product to replace the unavailable Product. If we are unable to reach you, you acknowledge and agree that we may send you a replacement product of the same or greater value. Products may appear different in color and style than as displayed on the Site.
CLEAN AND READY TO USE. The Products will be cleaned and delivered ready to use. TBLE inspects and sanitizes each Product with the utmost care, but use of the Product is at your own risk and TBLE shall not be held liable for any health-related complaints associated with any Product.
